University faces lawsuit for research (with documents)

Abstract:
A federal lawsuit filed against University researchers, professors and the Board of Regents alleges that fabricated data from published research resulted in more than $1 million in federal grants for the University. Two farming families and David L. Lewis, a former microbiologist for the Environmental Protection Agency and an adjunct senior research scientist in the School of Ecology, filed a lawsuit against several University-affiliated parties, including John Walker, Julia W....

The editors of the Red and Black are to be commended for digging up these documents of this lawsuit. Everyone should notice how it has been kept under the rug by sealing the information since 2006. This is not the only area where the so-called "University" of Georgia has been seeking to fool a gullible and unwitting public. For years now I have asked that participants in the annual Relay for Life event which has often been carried out on public property on campus be provided with copies of, and required to read, the article by Samuel S. Epstein, M.D. "American Cancer Society America's Wealthiest 'Non-Profit' Institution", published in the International Journal of Health Services, 1999, also available at www.preventcancer.com. Dr. Adams and former Governor Barnes both failed to do so. This was documented in "An Unsuccessful Effort to Deny Use of State of Georgia Facilities for Fund Raising by the American Cancer Society" by Winfield J. Abbe, Ph.D., May, 2000, available at the UGA library. Furthermore, following the visit to the campus of the former CEO of the American Cancer Society, one John Seffrin, Ed.D., to give a propaganda talk on cancer in about 2001, where he was either unable or unwilling to address the many criticisms of Dr. Epstein at the talk following a question from me there, I requested former Provost Karen Holbrook, Ph.D. to invite Dr. Epstein to the campus to present his side of all this, or the truth to a gullible and unwitting faculty, students and public at large. She quietly refused as did Dr.Adams. The local newspaper, the Athens Banner Herald even silently refused to publish a letter to the editor by Dr. Epstein demolishing most of what Dr. Seffrin said about cancer in the lecture, but without notifying their readers of the failure to publish the letter.
I even challenged the newspaper that if they could prove everything Dr. Epstein said about the American Cancer Society in the 1999 article in the International Journal of Health Services were not true, I would donate $10,000 to the Relay for Life that year. The newspaper quietly, through their then Executive Editor, Mr. Bentley, rejected my challenge, again without notifying their readers of the existence of the challenge or their reasons for rejecting it if they had any.
It is interesting that Mr. Bentley subsequently left the newspaper to become employed by UGA. By the way, as documented in my monograph above, while holding me to strictly 500 words and no picture images in opposition to the American CAncer Society in an article published in the newspaper, the Athens Banner Herald published about 12,000 words and 3 pages of picture images in favor of the American CAncer Society that year. Is it any wonder, then, that most people are brainwashed by the American Cancer Society, especially when they dole out "research" money to professors, as some at UGA, who have been going down the failed genetics road of cancer research for decades with basically zero, success? After all the billions of public and private dollars squandered on cancer research by the cancer generals, about one person dies every minute either from cancer, "treatment" or a combination thereof. This is FAILURE, not success by any standard. The underlying cause of this failure, other than total negligence, is the failure of the medical orthodoxy to acknowledge the seminal discoveries of Otto Warburg, M.D., Ph.D. in cancer research in Germany decades ago; namely, cancer is caused by the wrong energy supply; fermentation instead of oxygen. Only oxygen is capable of cell differentiation of the higher living animals. The cancer generals have willfully and negligently failed to read and comprehend and understand all this, due to prejudice, ignorance and incompetence and because they were simply not as good as the genius Otto Warburg, M.D., Ph.D., who was nominated for 3 Nobel prizes for 3 different pieces of work; 1926 for the cancer work; 1931 award actually awarded for cell respiration; and 1944 for other work. Three of his pupils also were awarded Nobel prizes in medicine; Otto Meyerhoff, Hans Krebs and Hugo Theorell. This illustrates how good he was. A recent book documents the cancer research: "The Hidden Story of Cancer" by Brian Peskin, E.E. and Amid Habib, M.D., Pinnacle Press, Houston, 2006-2007. A copy is in the UGA library and the Athens Public LIbrary on Broad St.
And UGA expects to operate a medical school! I hope and pray I never have to be lied to by one of their medical graduates as they lie to the public about these vital issues and permit "scientists" to falsify published information.

It will be interesting to see if this is another Adams faux pas, another reason that will ultimately give UGA a black eye in the scientific community and cost reputation and grants. While I can understand that a college president cannot keep his finger on the pulse of every action that someone on the staff initiates, if it is done in the name of the University he should at least have a passing knowledge and especially once he was informed of the problem. This one will be interesting to watch.

It looks to me as if the suit doesn't have much merit. The "falsification" reportedly consisted of collecting samples during a drought. Well, how do you turn off a drought?

My favorite part is:

"We haven't studied the lawsuit, but this heightens our concerns about the University's assurances of safety regarding the NBAF," Grady Thrasher, co-founder of Foundation for Athens Quality of Life, an anti-NBAF group, said Thursday in a phone interview.

That's value added. I read this as "I know what I know, don't confuse me with the facts."

The same plaintiffs' already sued the City of Augusta on the same basic facts under a qui tam theory in the Northern District of Georgia. The plaintiff's lost, appealed that to the 11th Circuit and lost again.

See http://www.ca11.uscourts.gov/opinions/ops/200616493.pdf

If the Red and Black reporters were really as good as y'all claim -- how could they have overlooked the prior lawsuit?

More facts you don't want getting in the way?

Like Shakespeare used to say through one of his characters in Hamlet: "Something Is Rotten in the State of Denmark"... only that Denmark here is this silly situation with no proper subject.
